Sexual harassment is very touchy, yet it has been turned into a buzzword; it should be decided based on the situation and not any strict ruling.

How do you know the situation though? The victim and the accused are certainly going to have differing accounts.
Concrete rules are a very imperfect situation but in a world without perpetual, omnipresent surveillance so is going through everything on a case-by-case basis.

Concrete ruling is important, but it shouldn't be the entire basis. Maybe background checks of the people would help out too nam saying

Honestly I'm not sure background checks would help at all? We're talking about someone being a creep here basically, that isn't the sort of stuff that's particularly likely to appear on a record.
Sure they might have been convicted for it before but there has to be a first time even for every repeat offender.

I think it's just a jerk-knee response to social hysteria.. it's like the PATRIOT Act, but for awkward comments. I don't like the idea of political correctness being forced on everyone, it's a bit synonymous with newspeak, god the 70's would have a field day on this.
