If they actually turned the safety off and held it to their head, then yeah, they deserve what is coming to them.

Safety on or off, pointing a gun at your head means you deserve it, safety catches aren't 100% failproof.

If the gun isn't loaded and the safety is on, then it's harmless. In fact the safety doesn't even have to be on if it isn't loaded.
Unless thrown of course.
There's also the possibility that it's fake.

I'm pretty sure that's a fake grab for attention, but even if the gun isn't loaded with a magazine there could still be a round chambered, rule of thumb, no matter how many precautions you take, don't point the gun at anything you wouldn't want to shoot.

I'm pretty sure it was obvious when I said "the gun isn't loaded" that I also meant "THE GUN HAS NO BULLETS IN IT WHATSOEVER".
