I looked up cortex command demo and a download page came up on the datarealms website, so i downloaded it to my mac but is it a legal free version of b23??, if it's illegal i will delete it and buy the game.

While it isn't illegal, build 23 is woefully outdated. You won't be able to enjoy many of the mods available now and it will be hard being active in any kind of discussion related to the game on our forums.

No, what you have is a trial version - you should find that it has a six minute time limit on every activity other than the tutorial.

That isn't the official e-mail, though by the looks of it it's a placeholder easily registered account by Data.

If the download was not from datarealms.com, then it wasn't official. B23 isn't "free" persay, but you can find a registration key on the forum somewhere that will allow you to play it for as long as you like. Think of it as an extended demo of a version from a few years ago.
