Basically, Bethesda is being ass-ish about Mojang calling their next game Scrolls, since it sounds too much like The Elder Scrolls (it doesn't.) so the legal team is sending a cease and desist to get Notch to change the name.
Notch has tried to be reasonable, and Bethesda didn't agree. So now Notch has thrown down the gauntlet.

No discussion necessary. Notch is awesome and Zenimax/Bethesda will lose their quest for nonsense, just like that Edge guy. Dunno what the hell they're on, but it's definitely damaging their brains.

Copyrighting single words... If that's the way of the future then I'll copyright the word "Hello" and sue everyone who uses it. -_-

I have an uneasy feeling they're not going to drop the lawsuit even if notch wins. Law doesn't work that way.

Zenimax Media and Bethesda Softworks are suing Mojang, LLC, under grounds of copyright infringement with the new Bethesda Game Studios title The Elder Scrolls V: Skyrim.

Bethesda means two different things; lumping them together does neither justice.

That should be how we settle all legal matters from now on. Divorce custody case? Sit those two down for a couple games of Unreal Tournament. First to 3 wins gets the kids.

If Bethesda accepts the challenge I won't care who wins.

It does if they legally agree to it. As long as their legal team can put the challenge and terms into legalese and have both parties sign on it, it doesn't matter.

Imagine if instead of lawyers we had mercenary Quake players. Big offices with their fancy suits and headsets, consulting you on how to manage powerups.

It's probably that a game of quake is funner, faster, easier, and cheaper for pretty much everyone. Not exactly FAIRER, but the Bethesda Legal types aren't being very nice either.

The world isn't fair, so it would balance itself pretty evenly.

Notch is a big lovable ball of fun.
He likes being a ball of fun. I doubt the reason he's doing this is because he's scared. I'd say it's just for comedic effect. After you've read enough of what he's written you'll understand he tends to be very sarcastic.
Either way if he didn't use this Quake game as a dealbreaker I think he would have won the lawsuit hands down.
NOBODY, and I mean NOBODY, would ever get TES confused with just 'Scrolls'. Everyone I've ever met calls the game it's respective title, not the series name, unless they're talking about the series. Just like ever other game/series in existence.
You don't call Super Mario World 'Mario' unless you're that awkward uncle that has no idea what a video game is. I'm certain that anyone with half a brain that even knows what Skyrim is won't call it TES. They'll call it Skyrim, and rightfully so.
Unless they're that one creepy uncle that buys you games you don't want.
