Yeah the Elder Scrolls engine can't support more than about 40 AI in combat at once, if it does it can crash...or worse....[insert something dramatic here]

It's because the AI doesn't suck.

Or it's badly coded...

No, there are just tons of options for the AI and running too many in combat can crash the system.
